Terms of Use

1. Parties

This User Agreement is entered into between Fayra Media LLC ("Company" or "Data Controller"), headquartered at 169 Madison Ave Ste 11534 New York, NY 10016-5101 United States, and the individual ("User" or "Member") who downloads, registers for, and/or uses the Amore mobile application ("Application"). This Agreement becomes effective upon electronic approval.

2. Definitions

• ●Application: The mobile platform named "Amore" owned by {{companyName}}, enabling users to create profiles, match with other users, message, and interact.
• ●Service: All free or paid (Premium) features offered by the Company through the Application.
• ●Content: Photos, texts, biometric data (face verification data, etc.), location information, and all other materials uploaded by the User to the Application.
• ●KVKK: Turkish Personal Data Protection Law No. 6698.
• ●Privacy Notice: The informational document regarding the processing of the User's personal data, provided separately from this Agreement, pursuant to Article 10 of KVKK.

3. Subject and Scope of the Agreement

The purpose of this Agreement is to determine the terms and conditions regarding the User's use of the Application, as well as the rights and obligations of the Parties. By registering for the Application, the User acknowledges that they have read this Agreement in its entirety, fully understood its content, and accepted all its provisions.

4. Membership Conditions and Account Security

4.1. Age Requirement

Users must be at least 18 years old to use the Services. The User declares and undertakes that they are over 18 years of age. The Company bears no responsibility in case of false declaration.

4.2. Verification

The Company may request verification through email, phone number, or biometric data (face recognition/selfie verification) to ensure account security and prevent fake profiles. Membership will not be activated without email and phone verification.

4.3. Account Security

The User is personally responsible for password and account security. The Company cannot be held responsible for consequences arising from the use of the account by third parties.

5. Protection of Personal Data and Privacy

5.1. Data Controller

Fayra Media LLC holds the title of "Data Controller" under KVKK with respect to the User's personal data.

5.2. Processing Conditions

Basic membership data such as the User's name, surname, date of birth, gender, location, and contact information are processed as they are directly related to the establishment and performance of this Agreement (KVKK Art. 5/2-c). Processing of this data is mandatory for the provision of the Service.

5.3. Disclosure Obligation

The Company has informed the User about the purposes of personal data processing, the parties to whom data is transferred, collection methods, and legal grounds through the "Privacy Notice Regarding the Protection and Processing of Personal Data" presented during registration. The User acknowledges having read this notice.

5.4. Cases Requiring Explicit Consent

• ●Marketing and Commercial Communication: Sending campaign, promotion, and advertising-related commercial electronic messages to the User is subject to the User's separate explicit consent (Commercial Electronic Message Permission).
• ●Special Category Personal Data: Special category personal data such as the User's biometric data (face recognition verification, etc.) or health data can only be processed with the User's separate and explicit consent.
• ●International Data Transfer: Storage of personal data on servers located abroad or sharing with foreign-origin service providers is subject to the User's explicit consent or other conditions determined by the Board pursuant to KVKK Art. 9.

5.5. Data Security

The Company undertakes to take all necessary technical and administrative measures to prevent unlawful processing of and access to personal data. In the event of a potential data breach, the Company will notify the User and the Personal Data Protection Board as soon as possible.

6. User Rights and Obligations

6.1. Accurate Information: The User undertakes that the information provided during membership and on their profile is accurate, current, and complete. All responsibility arising from providing false information belongs to the User.

6.2. Lawful Use: The User agrees to comply with the Turkish Criminal Code, Turkish Code of Obligations, and other applicable legislation while using the Application; and not to share content containing threats, blackmail, insults, harassment, violence, discrimination, or content contrary to general morality.

6.3. Content Responsibility: The copyright and legal responsibility of all photos, videos, and texts uploaded to the Application by the User belongs to the User. The Company, as a hosting provider, is not obligated to monitor User content; however, it reserves the right to remove content that constitutes a violation upon complaint or ex officio and to suspend the relevant account.

6.4. Prohibited Activities

• ●Attempting to access the Application's source code
• ●Spreading viruses
• ●Collecting other users' data without permission (data scraping)
• ●Engaging in activities that would disrupt the Application's operation

7. Paid Services and Payment Conditions

7.1. Subscriptions: Some features within the Application (Premium membership, Boost, etc.) may be paid. Fees and payment conditions are clearly communicated to the User on the purchase screen.

7.2. Right of Withdrawal: The User has the right to withdraw within 14 (fourteen) days from the conclusion of the contract without giving any reason and without paying any penalty, provided that the performance of the service has not begun, pursuant to Consumer Protection Law No. 6502. However, the right of withdrawal cannot be exercised for digital content and services whose performance has begun with the User's consent.

7.3. Auto-Renewal and Cancellation: Subscriptions are automatically renewed at the end of the selected period unless cancelled by the User. The User may cancel their subscription at any time through the Application settings or the relevant app store (App Store/Google Play).

7.4. Card Information Storage: Credit or debit card information may be stored by secure infrastructure providers for the convenience of future purchases, only with the User's explicit consent.

8. Intellectual Property Rights

The intellectual property rights of the Application's design, software, database, trademark, logo, and all content created by the Company belong to Fayra Media LLC. The User may not copy, reproduce, or use these materials for commercial purposes without the Company's written permission.

9. Limitation of Liability

9.1. The Company does not guarantee that the Application will be uninterrupted, error-free, or secure. Service interruptions may occur due to technical failures, maintenance work, or force majeure.

9.2. The Company is not responsible for Users' interactions with each other, meetings they may have in real life, or any damages that may arise. The Company does not guarantee matches for Users.

10. Termination of the Agreement

10.1. The User may terminate this Agreement at any time by deleting their account.

10.2. The Company has the right to suspend or permanently close the User's account and unilaterally terminate the Agreement without prior notice if the User violates the provisions of this Agreement, KVKK regulations, or general moral standards.

11. Dispute Resolution and Jurisdiction

Turkish Law shall apply to disputes arising from this Agreement. Consumer Arbitration Committees and Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction for the resolution of disputes.
